On March 28, 2007 a proposed class proceeding was commenced against the Ontario Lottery and Gaming Corporation (“OLG”). The class proceeding sought to recover damages for persons who may have been deprived of winnings by unscrupulous vendors of lottery tickets.
The motion for certification of this action as a class proceeding was dismissed by The Honourable Justice Strathy on August 10, 2011. As proposed class counsel, we were instructed by the proposed representative plaintiff not to appeal this decision. Accordingly, this action has been dismissed on consent by further order of Justice Strathy.
PLEASE TAKE NOTICE that the commencement of this proposed class action involving retailer fraud suspended the running of the limitation period and, by virtue of the dismissal of this action, the suspension has been lifted and applicable limitation periods now continue to run. Therefore, if you intend to take action against the OLG based on retailer fraud, strict time limitations may apply and you should seek legal advice forthwith.
